3115214	无图 <p>Voters elected Donald Trump in part because they wanted a fighter. But increasingly it seems that in international trade, he’s good at shaking his fist for the cameras but utterly outclassed when he steps into the boxing ring.</p><p>Indeed, Trump may be more dangerous to his own side of a trade war than to the other guy.</p><p>Even after Trump’s climb-down — declaring a 90-day pause on many of the “Liberation Day” levies that sent the stock market reeling — America’s tariff rates remain the highest in more than 90 years. They amount to an enormous tax hike on consumers, with researchers previously estimating that they might add something like $1,700 in costs per year to a middle-income American family. They’re a reason many economists fear that the United States is slipping into a recession.</p><p>The most heated trade war is with China, and it’s there that I fear Trump has particularly miscalculated. He seems to be waiting for President Xi Jinping to cry uncle and demand relief, but that’s unlikely; instead, it may be the United States that will be most desperate to end the trade conflict.</p><p>China does have serious internal economic challenges, including widespread underemployment and a deflationary loop with no end in sight. The trade war could cost China millions of jobs, and that raises some risks of political instability.</p><p>Yet it’s also true that China has prepared for this trade war. I’m guessing some Chinese factories are already printing “Made in Vietnam” labels and preparing to ship goods through third countries. And China will fight with weapons that go far beyond tariffs.</p>America is vulnerable<p>China buys agricultural products and airplanes from America, and it can almost certainly get what it needs elsewhere. But where is the United States going to get rare-earth minerals, essential for American industry and the military-industrial base?</p><p>These days we rely on China for 72% of the 17 metals known as rare earths, used in everything from glass to ceramics to catalytic converters. And in the subcategory of heavy rare earths, China is the sole world producer of six.</p> <p> </p><p>China has already announced that it will limit the export of those six heavy-rare-earth minerals, as well as rare-earth magnets, of which it controls 90% of the world supply. In effect, China is the OPEC of rare earths. Without them, we’d struggle to produce drones, cars, planes, wind turbines and more. A single F-35 fighter plane contains some 900 pounds of rare earths, and a submarine may use more than four tons of them.</p><p>In 2010, when China and Japan were caught in a maritime dispute after a boat collision in contested waters, Beijing halted rare-earth exports to Japan. The result was a mad scramble in Japan to find sufficient rare earths to keep factories open, and Japan hurriedly became conciliatory and pleaded for a resumption in the trade.</p><p>Perhaps Trump thinks he’ll find alternative sources of rare earths. We should. But because rare earths are polluting to mine and process, it can take nearly three decades to get permission to open and operate a rare-earth mine in America, so finding substitutes won’t be easy.</p><p>Rare earths aren’t all that rare in nature, despite their name, and they offer a window into the vulnerability of the West’s military-industrial base and our dependence on China. Until 1995, they were produced mostly in the United States. But then China began refining them inexpensively, and the United States couldn’t compete (and didn’t seriously try to).</p><p>Trump’s concerns about China are in many ways legitimate: It has manipulated trade. He’s right that our weakness in manufacturing and supply lines is a critical security deficiency, especially given China’s strengths in areas like drones and batteries. I’d be delighted if Trump tackled these issues seriously with targeted tariffs, a crackdown on transshipments to evade tariffs, subsidies for critical industries at home and cooperation with allies abroad. Instead, it’s not quite clear what his aim is, and the United States has gone out of its way to antagonize allies.</p>Flashing lights<p>One alarming sign: Even before the latest tariffs, a poll in Southeast Asia found that for the first time, a majority of people there would choose China over the United States if forced to align with one side or the other.</p><p>China has other tools available in this trade war with America beyond stopping most exports of rare earths. It could stop its limited cooperation on narcotics and turn a blind eye to its greedy private companies that would like to export fentanyl to America or fentanyl precursor chemicals to Mexico. Conversely, it could tighten shipments to the United States of cardiovascular or cancer medicines that Americans rely on.</p><p>China could also dump U.S. Treasuries for a few days, panicking the bond market and weakening the dollar. I doubt China would do this for long, because it would lose as well, but it might be satisfying for the Politburo to remind Trump who he’s messing with.</p><p>While all that’s going on, the People’s Liberation Army might cut multiple undersea internet cables leading to Taiwan. It could hold more military drills off Taiwan, the Philippines or the Senkaku/Diaoyu Islands. It has already burrowed into American infrastructure as part of its Volt Typhoon cyberespionage campaign and could try turning the lights off in a small American city or creating havoc for a day in the banking system.</p><p>A trade war may well be devastating for China as well as for America. But economic forecasters think a recession is far more likely in the United States than in China. And Xi may now have a scapegoat for his economic underperformance, calling on his citizens to resist what he will portray as one more chapter in a two-century history of Western bullying. All in all, Xi may be better positioned to ride out a downturn than Trump.</p><p>There’s nothing wrong with picking the right fight and taking a stand, and China’s trade policies are a legitimate target. Stickers scrawled with handwritten prices are layered over laminated pages, each marking the crises of recent years —pandemic-era inflation and supply-chain issues, increases to California’s minimum wage, and now sweeping tariffs on Chinese goods.</p><p>Restaurant owners are holding their breath as they wait to see whether President Donald Trump doubles down on his trade war, or pulls back. The outcome is personal — high tariffs could cut further into the restaurants’ already thin margins, threatening their livelihood.</p><p>So far, the tariffs have been unpredictable. In April, Trump placed import taxes ranging from 11% to 51% on 57 other countries. Then, just a few hours after they went into effect, Trump reversed course, saying that the country-specific tariffs would be suspended for 90 days to allow him to negotiate with trade partners. But he left one major tariff in place — a 145% duty, applying only to China.</p><p>“It’s all we’re talking about all day,” said Charles Hong, the second-generation owner of the well-known Shandong Restaurant, in an interview in Mandarin. “The impact really depends, though — our president changes his mind all the time.”</p><p>He just did again. He worries that many of them may soon be in short supply — his importer told him that shipments have stopped as they wait to see how the trade war plays out. (No importer wants their shipping container to arrive on U.S. soil just before a reversal goes into effect.)</p><p>“We’re holding onto the inventory we have,” Hong said. “Eventually, some items will run out.” When that happens, he’ll have to take certain dishes off the menu, like the black fungus and snow peas, or the stir-fried beef and bamboo shoots.</p> <p> </p><p>Some businesses don’t have the luxury of waiting for Trump to change his mind.</p><p>Ali Roth, owner of the Blue Willow tea house in Berkeley, was a few days out from leaving on her annual trip to China for the spring tea harvest — when she typically buys 80% of her entire inventory for the year. 3115212	无图 <p>A consistent gripe has reached the ears of California lawmakers in Sacramento as customers’ energy bills rise to new heights, driven by the costs of destructive wildfires and other factors.</p><p>“They’re worried about bills going up,” state Sen. Jerry McNerney, a Democrat representing San Joaquin and eastern Alameda county, said in an interview. “It’s on my mind and everybody around here’s mind.”</p><p>McNerney, who took office in December after 16 years in Congress, is joining Democrats who control the levers of power at the state Legislature who say they’re redoubling their efforts this year to give energy customers relief from steep energy bills.</p><p>Energy rates in California are on average nearly double the rest of the U.S., according to the nonpartisan state legislative analyst’s office, and more than double rates in neighboring states Oregon, Nevada and Arizona. Prices are highest for customers of the state’s big investor-owned utilities, including PG&E, the main electricity provider in Northern California, which received regulatory approval to raise rates a whopping six times last year. The main reason for the constant uptick? Power line undergrounding and other fire mitigation costs for PG&E and top utilities totaled $16 billion since 2020, according to another legislative report —plus another $11 billion for fires themselves and insurance premiums.</p><p>“These are massive investments that are happening, and they’re really needed,” said Britt Marra, executive director of the San Francisco-based nonprofit Small Business Utility Advocates.</p><p>However,PG&E also raked in a record $2.5 billion profit last year.</p><p>Marra and other consumer advocates say customers are bearing too much of the system’s costs. They want state lawmakers to hold utilities accountable in the current legislative session, which kicked off in December.</p><p>PG&E executives have said that the cost increases will slow or stop if the utility’s own costs diminish for wildfire hazard mitigation. Regardless, McNerney said the company is unpopular in his conversations with voters.</p> <p> </p><p>“Whenever I mention PG&E, people have a negative reaction,” he said.</p><p>Democrats have promised to tackle the issue this year as part of their post-election focus on California’s high cost of living.</p><p>In the state Senate, Sen. Josh Becker, a Menlo Park Democrat, kicked off the session in January with an informational hearing that saw Sen. Aisha Wahab, Hayward Democrat, grill the president of California’s Public Utility Commission that regulates power providers.</p><p>“Ratepayers are not a bank,” Wahab told commission president Alice Busching Reynolds during the meeting of the Senate energy, utilities and communications committee. “I’m deeply disappointed in the fact that ratepayers are being treated like an endless bucket of money, because they are not.”</p><p>The most influential bill introduced so far this session is Becker’s Senate Bill 254, which was released in its expanded form on Tuesday.</p><p>The bill is intended to give ratepayers relief by paying for some projects with other sources of funds, expand subsidies for low-income residents and provide all customers with credits to use during summer months when bills are priciest. California risk maps are 8 years old PG&E target of lawsuit after Santa Cruz County apartment explosion Rooftop solar is not the culprit behind high California electric bills, advocates say Plug and Play AI startup incubator launches downtown San Jose tech hub <p>The influential consumer advocacy group The Utility Reform Network supports the bill for its combination of long-term cost reductions for ratepayers and immediate relief, executive director Mark Toney said in an email.</p><p>Democrats have already introduced a slew of bills to blunt the high cost of energy bills — including ambitious bills by local lawmakers that were quickly cut down by Becker’s committee on Monday, a familiar tale in a state legislature where utilities hold major sway.</p><p>The committee overwhelmingly passed Senate Bill 24, introduced by McNerney, which aims to prevent utilities from spending ratepayer dollars on political lobbying and advertising by closing loopholes in the law. It would add teeth to existing law that bans utilities from spending the public’s funds to fight policy they may not agree with, such as municipalization, McNerney said. If passed, his bill would fine utilities $10,000 each day they violate the law and kick refunds back to rate payers.</p><p>However, the Democrat-controlled committee signaled it wouldn’t support a provision in the bill to bar utilities from shutting off power to customers on days of unhealthy air quality. McNerney said that part of the bill was “too broad” but intended to support vulnerable residents.</p><p>“It would be nice to find some way to protect people who are on the margins and having trouble breathing,” he said. “But we have to take what we can get at this point.”</p><p>Wahab on Monday also accepted major amendments to her ambitious proposal, Senate Bill 332, which would have capped energy bill increases at the rate of inflation and would have limited power shutoffs to pregnant customers, seniors and other vulnerable groups who can’t or don’t pay their bill.</p><p>Wahab struck those clauses and another major part of the bill that would have required the state to study and implement a plan to ditch major utilities altogether. That designation requires the developer to conduct a full assessment of how their project will substantially impact the historic value of the building, the Save the United Artists Theater Berkeley group argues.</p><p>Housing developer Panoramic Interests, on the other hand, submitted technical reports that argued the building has been modified so much over the years that it no longer contains critical characteristics that reflect its historic qualities. All that the developer would need to preserve is the facade of the building, which was deemed a historic resource worth protecting by the city’s Landmarks Preservation Commission in 2024.</p><p>“We are doing everything that the LPC asked us to do in this project, which includes restoring the facade, restoring the lobby and incorporating the significant architectural details that remain in the building in the new structure,” said Panoramic Interests owner Patrick Kennedy.</p><p>City staff sided with the developers despite a commissioned peer review that found the project would likely have a significant impact on the historic site. The Zoning Adjustment Board granted Panoramic Interests the approval it needed to demolish the building this past December.</p><p>That decision was appealed to the city council which, during a special meeting Tuesday, voted to back the Zoning Adjustment Board’s decision and grant the developer demolition rights. While sympathetic to the preservation group’s arguments, councilmembers said they stand by staff’s assessment of the issue, shared doubts the theater can be profitably reopened and underscored the benefits the new project would bring to the city.</p> <p> </p><p>In addition to new housing, including 27 below-market-rate units, the project would bring with it an estimated $7 million in development fees and about $2 million annually in property taxes to the city.</p><p>“I understand how hard it is to say goodbye to this place full of memories. I’ve seen probably 50 movies there. The change is inevitable,” Councilmember Shoshana O’Keefe said after rattling off the names of other theaters and performing arts spaces still operating in the city. “If we want those cultural venues to survive and we want a vibrant downtown, we have to move toward growth. We have to say goodbye to this. It’s not coming back and we need to instead bring more people downtown.”</p><p>Save the UA group founder Rose Ellis, a long-time renter who said she lives paycheck to paycheck and is currently caring for three family members with disabilities, said she understands and supports calls to build more housing. Their movement wasn’t aimed at stopping the project altogether.</p><p>It’s hard to say when construction will begin given market uncertainty, partly related to discussions around tariffs, Kennedy said Tuesday. After breaking ground, construction will take about two years, he said.</p><p>With the council’s decision now made, Save the UA is now left to consider pursuing possibly the last remedy to preserving the theater, a lawsuit. 3115210	无图 <p>By John Fritze \| CNN</p><p>The Supreme Court indicated Wednesday that it will revive a lawsuit from fuel producers challenging California’s strict vehicle emission rules, with both conservative and liberal justices signaling that the companies have standing to sue.</p><p>Several of the justices suggested a federal appeals court in Washington, DC, erred when it barred the fuel makers’ suit on the theory that market forces are driving the national push toward electric vehicles far more than California’s tough regulations.</p><p>“Wasn’t the goal of the California regulations to reduce the use of petitioner’s fuel?” Justice Clarence Thomas, a conservative, pointedly asked the attorney representing the EPA, suggesting that dynamic gave the companies a reason to sue over the policy.</p><p>Thomas wasn’t alone in that view. Justice Elena Kagan, a member of the court’s liberal wing, noted that when the Environmental Protection Agency reestablished the waiver during the Biden administration, officials at the time suggested they were doing so to reduce reliance on fossil fuels.</p><p>“Didn’t the EPA, in fact, in its submission to the courts, say that the effect of the reinstatement was going to be to reduce gasoline emissions?” Kagan asked.</p><p>Justice Brett Kavanaugh, another conservative, noted that the federal government didn’t challenge whether the fuel makers could sue in the DC appeals court.</p><p>“Isn’t that a tell, here?” he asked.</p> <p> </p><p>Given California’s size, automakers have for decades hewed to the state’s tighter emissions controls, which are permitted under an on-again-off-again EPA waiver. Democratic presidents have supported the waiver, while President Donald Trump has not.</p><p>The Supreme Court specifically declined to review the broader legality of the waiver, denying an appeal in December that raised that very question. Instead, the court agreed to decide if the fuel producers – as a function of selling less fuel because more electric vehicles are on the road – were injured by the EPA’s waiver.</p><p>While a majority of the court seemed sympathetic to the idea that the fuel producers should be permitted to sue, it was less clear after a little over an hour of arguments whether the court will embrace a firmer rule on the issue that could affect future cases.</p>Will Trump end the waiver?<p>One of the factors a party must demonstrate to establish standing is redressability, which in basic terms means that the court’s order can actually fix the plaintiffs’ problem. California argued that even if courts eliminate the waiver, that won’t help the fuel producers because consumer demand is driving the market toward electric vehicles on its own.</p><p>It’s not clear how much practical impact the court’s decision would have either way given that President Donald Trump seems almost certain to withdraw the waiver, just as he did during his first administration. The waiver was then reinstated by President Joe Biden.</p><p>Several justices pressed Edwin Kneedler, the attorney representing the EPA, on that point.</p><p>“By my count, the EPA has now changed its mind on this four times,” said Justice Samuel Alito, a conservative. “So what is the probability that there will not be a fifth?”</p><p>Kneedler noted that Trump signed an executive order asking the EPA to examine the issue.</p><p>“I mean, just out of curiosity, is there anything you can say about the timing of that process?” Kagan said.</p><p>“Not at this point,” Kneedler tactfully responded.</p><p>It’s a point that Jeffrey Wall, representing the fuel makers, was quick to jump on. If the Trump administration unwinds the policy, it is almost certain to tout that decision as wiping away a burdensome regulation on car manufacturers and fuel producers.</p><p>“I bet my bottom dollar … that in some number of months, the EPA will withdraw the waiver and will say this waiver has been having an effect from the time it was reinstated,” said Wall, who served in the Justice Department during the first Trump administration, including as acting solicitor general. “If the EPA says that in a number of months, it will be right.”</p>Applause for veteran attorney<p>In a rare moment of levity at the end of the arguments, Chief Justice John Roberts recognized Kneedler for arguing before the high court 160 times. 3115209	无图 <p>There’s only one place outside of California where you’ll spend more of your paychecks on housing.</p><p>My trusty spreadsheet calculated how much typical households spend on housing expenses by reviewing a cost study from WalletHub and homeownership levels from the Census Bureau.</p><p>The math shows housing expenses eat up 44% of a typical California household budget. Only Hawaii at 53% was higher. No. 3 was New York at 42%, Massachusetts at 40% and Oregon at 37%. One big California rival, Florida, was No. 6 at 34%.</p><p>The national median was 26%. Iowans spend the smallest share on the roof over their heads at 19%, then Kansas at 20%, and West Virginia and Oklahoma at 21%. California’s other major economic competitor, Texas, was No. 34 at 24%.</p>How did we get there?<p>First, WalletHub says Californians who lives in their own place have the nation’s second-highest ownership costs, spending 46% of their incomes on the place they own.</p><p>Only Hawaii at 53% is higher. No. 3 is Oregon at 36%, then Nevada and Washington at 35%. Florida is 13th highest at 30%.</p><p>American homeowners spend 26% of their income on house costs. 3115206	无图 <p>By MICHAEL LIEDTKE \| Associated Press</p><p>Google’s profits soared 50% in this year’s opening quarter, overcoming the competitive and legal threats that its internet empire is facing amid an economy roiled by a global trade war.</p><p>The numbers released Thursday by Google parent Alphabet Inc. indicated the company is rising to the challenge so far, but investors are likely to remain concerned about the turbulent times ahead.</p><p>The Mountain View, California, company earned $34.5 billion, or $2.81 per share, during the January-March period, up from $23.7 billion, or $1.89 per share, at the same time last year. Revenue rose 12% from last year to $90.2 billion. The results easily exceeded analysts’ projections, according to FactSet Research.</p><p>“We continued to see healthy growth and momentum across the business,” Alphabet CEO Sundar Pichai told analysts Thursday during a conference call.</p><p>Alphabet’s stock gained more than 4% in extended trading after the numbers came out. The shares had fallen by 16% since the end of last year.</p><p>Google’s first-quarter performance illustrated the continuing power of its long-dominant search engine in a sea of uncertainty. While grappling with competitive threats emerging as artificial intelligence reshapes technology, Google is also battling court decisions condemning its search engine and digital ad network as illegal monopolies.</p><p>The AI-driven upheaval has opened new opportunities for people to find helpful advice, insights and information through more conversational search options from the likes of OpenAI and Perplexity.</p> <p> </p><p>Google’s long-dominant search engine is countering the new competition with a feature called AI Overviews that appear above web links in its results. It is also testing a conversational tool called AI Mode that would usher in an even more radical change to its business model.</p><p>“The company delivered a sound response to those questioning the solidity of the search business amid ever-increasing AI demand,” Investing.com analyst Thomas Monteiro said.</p><p>But Google is trying to keep its business intact as by the U.S. Justice Department attempts to break up the company and impose other restraints after a federal judge last year branded its search engine an illegal monopoly. To make matters worse, its digital ad network also was found to be illegally abusing its power earlier this month in another case brought by the Justice Department.</p><p>President Donald Trump’s trade war has injected more uncertainty into the mix by rattling the financial markets amid fears the tariffs will reignite inflation while dragging the economy into a recession. Although Google’s digital services aren’t directly impacted by the tariffs, a recession would likely curtail the spending on ads that generate most of Alphabet’s revenue.</p><p>But there were few signs of a slowdown in the past quarter. 3115205	有图 <p>With the opening of the Via del Oro interim housing community in San Jose, city leaders describe its value as more than justthe 150 beds it will offer unhoused residents.</p><p>They view the site — the first to be constructed on private land — as a potential model for future developments, bringing in private sector partners and philanthropists to help the city’s efforts in solving the homelessness crisis through building interim housing more quickly and at a lower cost.</p><p>“It’s proof that when public, private and nonprofit partners come together around shared goals, we can get big things done and fast,” San Jose Mayor Matt Mahan said. “We have to be honest (that) the city doesn’t have the taxpayer dollars alone to solve this crisis. We need support from our county, our state, philanthropic leaders and private partners, and this site is really our first test case of using private land and showing that these kinds of innovative partnerships can work.”</p><p>The interim housing community has become a genuine team effort since the City Council approved a project delivery agreement with DignityMoves to develop the site last year.</p><p>Lacking city-owned space for interim housing projects, San Jose found some relief from philanthropists John and Sue Sobrato, who agreed to lease the two-acre Via del Oro site, located at 6370 San Ignacio Ave., for $1 per year for the next 10 years.</p><p>Sobrato indicated Thursday that the site could potentially be expanded on the property he owns if it is successful.</p><p>“If this project turns out as we all expect, we still have land next door,” Sobrato said. “This is a two-and-a-half acre site, and we can double the amount of units on the remaining land.”</p><img src="https://www.siliconvalley.com/wp-content/uploads/2025/04/SJM-L-VIADELORO-02.jpg?fit=620%2C9999px&ssl=1" rel="noopener noreferrer">San Jose has opened its latest interim housing community, as seen on April 24, 2025, at 6370 San Ignacio Ave. that will offer beds up to 150 beds for unhoused residents. (Devan Patel/Bay Area News Group)<p>The city also received millions of dollars in discounts and donations that helped reduce costs for sleeping units, furniture, design, and project management fees.</p> <p> </p><p>Along with the Sobratos, Peter and Susanna Pau with the SHP Foundation, the Valhalla Foundation, Vinod and Neeru Khosla and Preston and Carolyn Butcher were among the other notable benefactors of the project.</p><p>HomeFirst is the nonprofit provider operating the site.</p><p>With outside help, Mahan stated that the project’s building costs were close to 10% lower than the average for interim housing sites. Mahan’s office confirmed that the average cost per bed was $115,000, compared to the $130,000 average across the city’s other sites.</p><p>When the City Council approved its agreement with DignityMoves, the city initially envisioned the site opening in winter 2025.</p><p>Adding to the uniqueness of the situation, the interim housing community is fully relocatable.</p><p>The Via del Oro site is part of the city’s ambitious push to add more than 1,400 shelter spaces to its portfolio over the coming year through hotel and motel conversions, tiny home communities and safe sleeping and safe parking sites. Earlier this year, the city opened a 216-bed facility in South San Jose at Branham Lane and Monterey Road. It also recently opened up its largest safe parking site in Berryessa.</p><p>The city’s efforts to ramp up interim housing production earned praise from DignityMoves CEO Elizabeth Funk, who touted San Jose’s efforts to end unsheltered homelessness.</p><p>“I like to think of this as the beginning of the end because San Jose has embarked on what is truly a remarkable initiative to reach what we call functional zero unsheltered, which means that the city has enough beds and options available so that people no longer need to resort to sleeping on the streets,” DignityMoves CEO Elizabeth Funk said. “That’s audacious (and) that’s also not possible if they try to do it alone. It’s not they have the money, and believe me, they’ve looked, but to name a goal and define it, you’re halfway to solving it.”</p><p>Since Via del Oro opened its doors, it has welcomed nearly 70 unhoused residents, including many from a nearby encampment on Great Oaks Boulevard.</p><p>So far, unhoused residents saythe new site has provided a welcome alternative to their previous living conditions and offered them hope of achieving their goals.</p><p>“It’s been awesome,” said Corrina Hernandez, who recently moved into Via del Oro after spending the last three years homeless. “It’s good to get a shower and sleep without worrying about people trying to get to you. 3115204	无图 <p>So far this legislative session, California Democrats in the state Senate have teased a package of bills that will supposedly cut down the expensive cost of living in the Golden State — the tip of the spear in their post-election focus on affordability.</p><p>Senate President Mike McGuire, who represents Marin County and the north coast, unveiled those plans Thursday after what he called “months of laser-focused work” with the input of two Bay Area lawmakers, Sen. Josh Becker of Menlo Park and Sen. Aisha Wahab of Fremont, who both chair powerful committees. In the package of three bills, two would make reforms to the bureaucracies surrounding utilities and home-building while aiming to give residents relief from their ever-rising electricity bills and renters’ costs like late fees. The third bill would expand the state’s career development programs.</p><p>The three bills are just the latest of a slew of proposals introduced in the state Senate and Assembly since the legislative session kicked off in December. Democrats hold supermajorities in both chambers and control the legislative process.A spokesperson for Gov. Gavin Newsom did not immediately respond when asked for comment.</p><p>“Our plan delivers real, lasting solutions to make our state more affordable—from housing, to utility costs, to expanding career opportunities across California,” McGuire said in a statement. “These three impactful bills should be considered an opening salvo; we know there’s much more work to do.”</p><p>Adding to the heap of housing-focused bills already introduced by Democratic lawmakers, Wahab is sponsoring Senate Bill 681, which makes tweaks to the bureaucracy around housing production and bans landlords from charging fees on top of rent.</p><p>“In recent years, the Legislature has passed over 200 bills intended to create more housing opportunities,” Wahab wrote in supporting materials for the bill, “but more can be done to increase the housing supply and make housing less expensive, particularly for lower-income Californians.”</p><p>The bill extends existing law that aimed to streamline home-building. The bill would keep in place legal requirements that force local governments to approve housing projects unless they would cause health and safety issues, while also limiting the amount of hearings that local governments can hold on a development plan — tactics that cities and counties had long used to squash new housing. Those rules will sunset in 2030 unless Wahab’s bill becomes law.</p><p>The bulk of Wahab’s bill deals with protections for renters and homeowners. It would prevent landlords from charging fees that aren’t spelled out in a lease agreement, and landlords also wouldn’t be able to charge late payment fees until after a weekelapses.</p> <p> </p><p>In supporting documents, Wahab said “more can be done to increase the housing supply and make housing less expensive, particularly for lower-income Californians.”</p><p>But no advocacy organization officially supports the bill, according to document filings. Debra Carlton, vice president of the California Apartment Association, which represents landlords and property managers, opposes the bill and arguesit would force landlords to raise rents.</p><p>“These fees charged by landlords are not punitive, instead they illustrate the costs associated with operating rental housing and can give tenants the ability to manage and reduce certain expenses, such as utility and water costs,” Carlton wrote in a letter this month. “Mandating that all fees be folded into rent will not reduce the overall cost of housing.”</p><p>Critically, Wahab’s bill would also prevent landlords from charginga fee for a parking space.</p><p>Under current law, tenants can decide whether they need to pay an additional $300 or $400 per month for parking, said Matthew Lewis, a spokesperson for the pro-housing advocacy group California YIMBY. He said Wahab’s bill would eliminate that choice and allow landlords and developers to fold the expensive cost of providing parking into rent — whether a tenant wants a parking space or not.</p><p>“It requires rent increases,” Lewis said of the bill. “The builder isn’t going to provide the parking for free.”</p><p>Becker’s bill, Senate Bill 254, is likely the most influential yet of Democrats’ proposals to bring down the high energy bills plaguing customers of PG&E and other investor-owned utilities in California.</p><p>Energy rates in California are on average nearly double the rest of the U.S., according to the nonpartisan state legislative analyst’s office, and more than double rates in neighboring states Oregon, Nevada and Arizona. That’s largely because of destructive wildfires, fire liability insurance and mitigation projects like burying power lines underground that ratepayers fund.</p><p>PG&E obtained approval from regulators to raise customers’ rates six times in 2024 while earning a record nearly $2.5 billion profit.</p><p>Becker’s bill would give ratepayers relief by paying for some projects with other sources of funds, expand subsidies for low-income residents and provide all customers with credits to use during summer months when bills are priciest. 3115203	有图 <p>The Port of Oakland, a vital bridge between the U.S. and its largest trading partners, especially China, faces a rapidly changing landscape of tariffs and stiff winds from an unpredictable Trump administration.</p><p>On Thursday, at a meeting at the port’s headquarters, port officials, business owners, a representative of the longshoremen’s union and Rep. Lateefah Simon aired concerns about how they could weather the administration’s erratic moves — implementing tariffs, cutting tariffs, delaying tariffs, raising tariffs.</p><p>Simon, a civil rights advocate who has represented California’s 12th congressional district since January, offered a blistering rebuke of President Donald Trump’s trade policies on key allies, saying he has created a “no-win situation” for the U.S. and global economy, which threatens to have devastating effects on the region’s job market, housing development and health care services. Already, new construction sites have started to stall, while shipments of equipment headed to UCSF Benioff Children’s Hospital in Oakland may delay ongoing development plans there, according to Adam Masters, a business representative from SMART, SMW Local Union No. 104.</p><p>“There’s a real potentiality of workers losing their jobs, but we cannot have a poorer, sicker California,” Simon said, comparing her district’s largest city to a patient in a hospital. “If there were no tariffs, Oakland would be in the emergency room. Hospice is terminal, but we’re in ICU. We have to convince businesses to stay here.”</p><p>The Port of Oakland handles 99% of all shipments into Northern California. The most important of these trading partners is China, which represents 48% of all imports and 7% of all exports at the port.</p><p>China currently faces a 145% tariff on U.S. imports as a trade war between the world’s two largest economies has escalated over the past two months. Trump asserted this past week that the two countries were in active negotiations to create a new trade deal. Chinese officials, however, have repudiated the president’s claims about negotiations and called for an end to unilateral tariffs.</p><p>The port’s two largest receivers of goods, Japan and South Korea, were among the first countries to enter discussions with Trump to lower tariffs. Japan is responsible for 15% of all exports from the Port of Oakland, while South Korea adds an additional 11% of exports. Japan faces a 24% tariff on its goods while South Korea faces a 25% tariff.</p><p>Prior to Thursday’s meeting, the Port of Oakland announced a 6.3% year-over-year increase in container volume, representing a total of imports and exports, buoyed in the first quarter of 2025 as businesses rushed to push through goods before further tariffs were enacted. The port reported a 7.2% rise in shipping volume in March compared to the same time period last year. We want clarity around where we’re going,” McKenney said. “It’s terribly important that, as we move forward, we have an understanding so that these tariffs don’t have all those negative impacts and can be used for an ultimate common good outcome.”</p><p>In recent months, the whipsaw of tariffs has challenged Bay Area business owners who rely on stable costs and international trade. Gavin Newsom credit.</p><p>You can call it grandstanding and opportunistic, but suing President Donald Trump over tariffs was smart, bold and much needed.</p><p>Sure, it was political.</p> <p> </p><p>Newsom adroitly leaped ahead of other potential 2028 presidential contenders by taking aim through the court system at Trump’s allegedly illegal actions on tariffs.Someone needed to seek a judicial ruling on whether the president can raise tariffs himself without congressional approval.</p><p>Republican congressional leaders — Republican politicians generally — are too intimidated by their president to sneeze without his blessing. They’re meekly ceding their co-equal legislative power to the president. And that’s worrisome for democracy.</p><p>It’s about self-preservation. Republican members of Congress who must survive GOP primaries to win reelection fear getting on the bad side of the vengeful president and being “primaried.”</p><p>“Where the hell is Congress? Where the hell is Speaker [Mike] Johnson? Do your job!” Newsom proclaimed while announcing his lawsuit last week at an almond orchard near Ceres in the agriculture-rich San Joaquin Valley.</p><p>“They’re sitting there passively [as Trump] wrecks the economy of the United States.”</p><p>Actually, Newsom seemed to be crashing Attorney General Rob Bonta’s party.</p><p>Newsom and Bonta jointly filed the lawsuit in U.S. District Court in San Francisco. But Bonta — often working with other states’ Democratic attorneys general — already had filed 14 lawsuits challenging Trump policies. Bonta’s staff had spent significant time drafting the tariff suit before Newsom publicly surfaced as a plaintiff.</p><p>“The president is acting as if he’s above the law. He isn’t,” Bonta said before introducing Newsom at the almond farm. “Congress has the duty to set taxes, duties and, yes, tariffs.”</p>Risky business<p>For Newsom and California, challenging Trump in court is a bit risky. The president has threatened to retaliate against California by withholding federal funds if state policies conflict with his. That includes money to help rebuild fire-ravaged sections of Los Angeles.</p><p>That’s not just an idle threat, as Trump has shown in pulling back federal funds promised for universities and strong-arming law firms that have opposed him in court cases.But as most of us learned as kids, you’ve got to stand up to a bully. And that’s what Newsom did.</p><p>“No doubt, Trump isn’t going to give California anything anyway,” says Democratic political consultant David Townsend. “This is a good political move by Newsom to position himself as anti-Trump on a solid policy issue.</p><p>“All Democratic voters are looking for a strong anti-Trump leader.”</p><p>OK, so Newsom is reading the tea leaves and realizes that lots of people are clamoring for a crusader to carry the fight against Trump’s policies.</p><p>That was demonstrated on the night before Newsom’s announcement when Sen. Bernie Sanders and Rep. Alexandria Ocasio-Cortez — two East Coast democratic socialists — attracted nearly 30,000 people at an anti-Trump rally in a Republican congressional district near Sacramento.</p><p>An essential ingredient of democracy is elected officials following the citizens’ will. And that’s clearly what Newsom is now trying to do on tariffs.</p><p>“I can’t imagine anything more unifying” for California than challenging Trump on tariffs, Newsom said. “We were hoping we didn’t need to go down this path. But we [are] prepared to go down this path.”</p><p>Trump’s “unlawful tariffs are wreaking chaos on California families, businesses and our economy — driving up prices and threatening jobs,” Newsom said in a prepared statement.</p><p>The lawsuit represents a shift in Newsom’s strategy toward Trump. Previously, he has been practically mute, seemingly trying to play nice to avoid Trump’s wrath that could cost California federal money for disaster relief, higher education and Medi-Cal healthcare.</p><p>Contrast that soft-tongue tactic with another Newsom announcement last week unveiling a lawsuit challenging Trump cuts to the AmeriCorps service program in California.“We’ve gone from the New Deal, the New Frontier and the Great Society to a federal government that gives the middle finger to volunteers serving their fellow Americans,” Newson declared in a prepared statement.</p><p>Middle finger? Not exactly traditional gubernatorial lingo. But no bureaucratic bull, either.</p><p>Governors wouldn’t ordinarily file a court case contesting a president’s foreign policy. But this is not like suing Trump for cozying up to Russian President Vladmir Putin, puncturing our European alliances or bizarrely threatening to seize Greenland. On tariffs, California has judicial “standing” as an aggrieved victim.</p><p>“No state is poised to lose more than the state of California,” Newsom said.</p><p>“We talk about stupidity,” Newsom continued. “This [tariff action] is the poster child for that.”</p>Trade dependent<p>Newsom noted that California’s gross domestic product was $3.9 trillion in 2023, which was 50% bigger than that of the next-largest state, Texas. If this were a country, it would be the fifth-largest economy in the world.</p><p>We’re the nation’s leading agriculture producer and there are more than 36,000 manufacturing firms employing 1.1 million people.</p><p>China, Mexico and Canada — special tariff targets for Trump — supply more than 40% of California’s foreign imports. They’re also the top three export countries. That will stem from collapsing businesses that rely on foreign imports or exports — exacerbated by reduced consumer spending as prices rise on everything from food to cars.</p><p>Although Newsom and Bonta insist that Trump can’t impose tariffs without congressional consent, this isn’t a clear-cut case. 3115201	无图 <p>Progress in solving California’s unquestioned housing shortage can often be measured by the number of permits issued for new construction or conversions of existing office towers.</p><p>However, Berkeley, a college town that rarely fears trying approaches different from most other cities, now has a new wrinkle that might add as many as 4,000 new units to its housing stock: providing ways for owners of unpermitted secondary housing units to get them certified for the rental or sales market.</p><p>Many of these units were built to house adult children and other family members with a bit of separation from the property-owning families. Some have previously been rented out, but owners felt they were “burned” by irresponsible tenants. Many of these units have not been rented recently, some for many years.</p><p>Similar units exist in varying numbers in most California cities, which may watch Berkeley closely to see if its planned amnesty for owners will work. Essentially, many of these are “granny flats” dating to before California began easing construction of accessory dwelling units (ADUs) with a series of laws passed starting in 2016.</p><p>Since then, about 80,000 permits have been issued for building ADUs behind or beside existing homes. Many newly built homes come with ADUs, which owners can rent out to raise money for use toward mortgage payments. A law passed last year will also let ADU owners sell them off, essentially subdividing their property even where local laws previously forbade it.</p><p>The law was passed to provide a way for first-time buyers to begin gathering equity from their homes, even if they are small. In many cases, owners have long felt they might be assessed heavy fines for building without permits or renting units not formally certified as being up to current building standards.</p><p>Now Berkeley has activated an amnesty program due to last about four years, until early 2029. Owners will be encouraged to contact city planners and building inspectors to get their units legalized if they meet today’s standards or to learn what they would have to do to get their units to that point and how much that could cost.</p><p>Berkeley will offer certificates of occupancy, which tell renters or buyers that a unit is up to code, and certificates of compliance, which establish that a unit meets minimum fire and other life safety standards, even if the unit may not have sufficient insulation, central heating or other features required in new housing.</p> <p> </p><p>City officials, who sorely want more affordable housing UC Berkeley students and others, insist their new program will not allow unsafe housing. So expect that some owners will have to eliminate exposed electric wiring and other fire hazards before they can legally rent their extra units.</p><p>However, those expenses would almost always be offset by rents received in the first few months of occupancy. So this is a way for longtime homeowners to gain income after getting little or nothing from extra units while keeping them off the rental market. It’s also a way for Berkeley and maybe other cities to help meet their state-mandated obligations to allow more affordable housing.</p><p>Knowing some longtime owners will be hesitant to come forward for fear of incurring large new expenses, Berkeley says it will aim to “make it easy” for them by having a staff of building officials available to work with anyone who applies to get a unit legalized.</p><p>If the city lives up to its stated aims and others follow up too, this could be a way to add thousands of units to a housing market that desperately needs them. It’s also a way to create housing without disrupting anyone’s environment or the character of any locale. California risk maps are 8 years old PG&E target of lawsuit after Santa Cruz County apartment explosion <p>“We’re intently focused on affordability as an important outcome for both our customers and investors,” PG&E Chief Executive Officer Patricia Poppe said during a conference call this week to discuss the company’s financial results for the January-through-March first quarter of 2025.</p><p>Monthly electricity bills for the typical customer averaged about $215 in March, down 3.2% from a monthly electric bill average of $222 in March 2023, PG&E reported in a recent post about trends in bills.</p><p>“Our bills are down in 2025 compared to 2024, and we forecast them to go down again in 2026,” Poppe said during the conference call.</p><p>Despite the recent trend and a hopeful outlook for costs that ratepayers must bear in the near future, the current bill levels have soared far higher than they were before.</p><p>PG&E’s monthly bills are still way too high,” said Mark Toney, executive director of The Utility Reform Network, or TURN, a consumer group.</p><p>Monthly bills in January 2025 for customers who receive combined electricity and gas services from PG&E were $295. That was up $1, or 0.3%, compared with the combined bill of $294 in January 2024.</p> <p> </p><p>The sedate rise from early 2024 to early 2025 tells merely the latest chapter of what’s been a grim narrative for PG&E customers, in Toney’s view.</p><p>“Monthly bills are up 70% from just a few years ago,” Toney said.</p><p>In January 2020, PG&E monthly bills were roughly $175 a month for combined services. That means the January 2025 average bill was 68.6% higher than it was five years ago.</p><p>The 2020 figure was followed by a January 2021 monthly bill of $188, a 7.4% increase. The January 2022 combined bill was $221, a 17.6% increase from 2021. The January 2023 bill of $241 represented a 9% increase from 2022. The monthly bill that averaged $294 in January 2024 was an eye-popping jump of 22% from early 2023.</p><p>Toney argues that consumers experienced huge yearly increases in monthly bills because state regulators allowed PG&E to charge customers too much for wildfire mitigation work that should have been done sooner.</p><p>“PG&E was allowed to overspend for wildfire mitigation,” Toney said.</p><p>Despite the decrease in monthly electricity bills, PG&E nevertheless generated higher first-quarter revenue from both its electricity and natural gas operations, according to the company’s latest financial results.</p><p>During the first quarter of 2025 compared with the first quarter of 2024, PG&E produced $5.98 billion in total operating revenue, up 2.1% from the year before.</p><p>Electricity revenue for the first quarter was $4.14 billion, up 2% from the year-ago first quarter. Gas revenue was $1.49 billion, up 2.2% from the same quarter the prior year.</p><p>Profits totaled $607 million during the first three months of 2025, down 17.1% from the company’s profits in the same January-through-March first quarter of 2024.</p><p>The utility disclosed to analysts during the conference call that it is preparing to file its general rate case in May with the state Public Utilities Commission. 3115199	无图 <p>In a surprise move, Jack in the Box announced this week it would be closing as many as 200 of its restaurant locations, in addition to possibly unloading Del Taco, a chain it purchased only three years ago.</p><p>The latest initiative by the San Diego-based fast-food chain will allow it to focus more exclusively on the Jack in the Box brand, while shuttering underperforming restaurants and raising cash to eventually pay down $300 million in debt, the company’s new CEO, Lance Tucker, said.</p><p>The closing of dozens of locations, none of which have been announced yet, will be done in phases with the first 80 to 120 to be shuttered by the end of this year. The company is calling its new strategy, “JACK on Track.”</p><p>“We expect closing these restaurants will strengthen the overall long-term economics of our franchisees, free up dollars for reinvestment, and allow the system to focus on maximizing performance of our stronger restaurants,” Tucker said during a Wednesday conference call with analysts and investors. “In short, we anticipate this program will better position Jack in the Box for more reliable, consistent, positive unit growth in the future.”</p><p>While Tucker did not indicate whether Del Taco is formally up for sale, he said that Jack in the Box is currently working with B of A Securities to explore a potential divestiture.</p><p>The decision to sell stores as well as the Del Taco chain comes at a time when fast-food restaurants in general face a number of challenges, including higher wages in California, food cost inflation and, more recently, a pullback in spending by consumers in the face of economic uncertainty.</p><p>The new strategy effectively returns Jack in the Box to its roots when the focus was solely on the burger chain. It no longer owns the Qdoba fast-casual Mexican brand that it purchased more than two decades ago and later sold. And it could soon be free of Del Taco as well. The purchase of the chain — for $585 million — closed in 2022.</p><p>“The problem is they bought Del Taco in the first place and paid too much,” said San Diego restaurant consultant John Gordon. “They hoped that they could sell off a bunch of Del Taco’s company-owned stores and there would be a lot more growth in Del Taco, not just from franchisees but also from Jack in the Box franchisees who would buy Del Taco stores, but that didn’t happen. It was a bet by the prior CEO, but one that didn’t pay off.”</p> <p> </p><p>Gordon said he and others have estimated that Jack in the Box overpaid for Del Taco by $200 million to $300 million,</p><p>According to the latest financial figures released by the company this week, same-store sales for both brands struggled during the last quarter ending April 13. They were down by 4.4% for Jack in the Box and 3.6% for Del Taco. In all, there are 2,191 Jack in the Box stores, of which the vast majority are franchised. The highest concentration of locations is in California and Texas.</p><p>There are nearly 600 Del Taco restaurants, with more than half in California.</p><p>In explaining the move to sell Del Taco, Tucker was careful to place no blame on the chain itself.</p><p>“I think highly of the Del Taco brand, and I think it can thrive,” he told analysts. “I just think it needs to be in a situation … where we need to focus on our own core business. It just makes a lot more sense to simplify our model, and they can move ahead and in addition to that, I don’t know (that) the results in the next several years are going to meaningfully contribute to Jack’s bottom line so I think it makes sense to move them on to another owner.”</p><p>He also acknowledged the timing of the purchase was not great, coming about a year before new legislation was passed mandating a $20-an-hour minimum wage for fast-food workers. The new hourly wage went into effect last year.</p><p>Gordon pointed out that the latest decisions were no doubt prompted, in part, by looming debt coming due. The company, he said, is facing repayment of more than $500 million in secured notes by February 2027.</p><p>“What may have frightened the board is that they’re thinking, ‘Oh no, we bought into this bad concept of Del Taco and now we have a debt payment coming up on it,’” Gordon said. “Normally, restaurants don’t like to close down units but now the situation is far more severe. They need to make the fixes to the system now so that later the base of the system improves and they can be in better shape.”</p><p>Jack in the Box’s stock price closed Thursday at $23.96 a share, down $1.45 or 5.72%. It will arrive on May 5, but a news release dated Thursday, April 24 from the fast food giant hints that some app users may be able to order them earlier and claims, “You may even see them in some locations today.”</p><p>McDonald’s describes the strips as white meat coated with crispy breading and “bursting with a bold, new black pepper flavor.” It will come with a new Creamy Chili Sauce.</p><p>The news release doesn’t mention portions or prices.</p><p>The last permanent menu addition was the McCrispy Chicken Sandwich in 2021.</p><p>McDonald’s broke the news on the same day Irvine-based Taco Bell brought back its Crispy Chicken Nuggets, which it says were a runaway success when they were briefly available in mid-December.</p><p>And Wienerschnitzel will introduce Bird Dogs on Monday, April 28, according to a news release from the Newport Beach-based chain.</p><p>Bird Dogs come from South Carolina and are chicken tenders served in a hot dog bun, the news release said.</p> <p> </p><p>Wienerschnitzel will serve three kinds: Bacon Ranch, Buffalo Ranch and BBQ.</p><p>Prices will vary but start around $4 a la carte, according to representatives. 3115197	无图 <p>Bay Area lawmakers are throwing their support behind a new state bill to tighten rent control, a proposal cheered by tenant advocates but met with fierce resistance from landlord groups across California.</p><p>Assembly Bill 1157, dubbed the Affordable Rent Act, would lower statewide rent caps already in place for most apartment buildings and expand the restrictions to single-family rental homes. The bill advanced out of the state Assembly’s housing committee on Thursday.</p><p>“With renters making up roughly half of the state’s population, California must take every step to help keep families from being displaced, keep workers near their jobs, and ensure no one is pushed into homelessness due to a substantial rent increase,” the bill’s author, Assemblymember Ash Kalra, a San Jose Democrat, said in a statement.</p><p>Democratic assemblymembers Mia Bonta from Oakland and Alex Lee from Milpitas co-authored the bill.</p><p>AB 1157 is one of at least 160 bills California lawmakers have proposed this year to alleviate the state’s housing crisis. They range from a measure to roll back environmental reviews that can stall new development to a $10 billion affordable housing bond and a now-amended bill that would have forced counties to help pay for city-operated homeless shelters.</p><p>The rent control bill aims to reform a 2019 law that expanded rent restrictions statewide. That law, AB 1482, capped rent hikes at between 5% and 10% a year, depending on inflation. It mainly applies to apartment buildings that are 15 years old or older.</p><p>If approved, the new bill would lower the rent increase limits to between 2% and 5% a year. It would also extend the rent caps to all rented single-family homes and condos, which are now exempt unless owned by a corporation, trust or LLC. Additionally, it would eliminate the current law’s 2030 sunset date, making the restrictions permanent.</p><p>The bill would not impact local rent control ordinances in cities including San Jose, Oakland, San Francisco, Berkeley and Mountain View.</p> <p> </p><p>Opponents of the bill argue that additional regulations on rents would discourage new housing construction because it would make it more difficult for developers to turn a profit.</p><p>They also point to academic studies showing that in areas with rent control, tenants are less likely to move, and some landlords opt to stop renting out their units. Fewer available rentals can mean higher prices for units without rent control.</p><p>“Policies like AB 1157 that penalize property owners while ignoring the core issue of housing scarcity will only worsen our problems,” the state’s most powerful landlord and real estate groups wrote in an open letter published this month.</p><p>Whether the bill has enough support to become law remains to be seen.</p><p>It comes less than six months after California voters resoundingly rejected a November ballot measure that would have allowed local governments to significantly expand rent control. It was the third time since 2018 that voters had shot down such a proposal after opponents labeled it a “housing killer.”</p><p>Gov. Gavin Newsom, who signed the initial statewide rent cap bill into law, opposed the recent ballot measure. (사진 = 뉴시스 DB) [emailprotected]</p></p></p><p>[서울=뉴시스] 이종희 기자 = 대법원이 미국계 사모펀드 론스타가 정부와 서울시를 상대로 제기한 1600억원대 세금 반환소송을 정부 승소 취지로 파기환송했다.</p><p>25일 법조계에 따르면 대법원 1부(주심 노태악 대법관)는 전날 론스타펀드 등 9명이 국가를 상대로 낸 부당이득금 반환 청구 소송 상고심에서 원고 일부 승소 판결한 원심을 깨고 사건을 서울고법으로 돌려보냈다.</p><p>앞서 론스타 등은 외환은행과 극동건설, 스타리스의 발행주식에 투자할 목적으로 자금을 출연해 버뮤다국에 KEB홀딩스 L.P. 등 지주회사를 설립하고 다시 벨기에에 LSF-KEB홀딩스SCA 등의 지주회사를 세웠다.</p><p>LSF-KEB홀딩스SCA는 2003~2005년 외환은행 주식 약 4억1675만주를 취득해 2007년 4167억5000만원을 배당금으로 받았고, 이후 증권사를 통해 주식 8770만주를 1조1928억원에 팔아 이득을 얻었다.</p><p>또 이들은 극동건설과 스타리스의 주식을 사고 배당금을 받은 후 이를 팔았지만 한·벨 조세조약 적용을 주장하며 별도로 세금을 납부하지 않았다. 이로 인해 당시 "먹튀" 논란이 크게 일었다.</p><p>이후 세무당국은 세무조사 후 배당소득 및 양도소득의 실질 귀속자는 지주회사들이 아닌 론스타가 맞다며 법인세를 부과했다.</p><p>론스타 측은 불복해 소송을 냈고, 세금을 취소하라는 판결이 2017년 10월 대법원에서 확정됐다. 국내에 고정사업장을 갖고 있지 않으므로 과세가 위법이라는 취지다.</p><p>이후 론스타는 취소된 법인세 중 일부를 돌려받지 못했다며 정부를 상대로 소송을 제기했다. 또 취소된 지방소득세도 돌려달라며 서울시 등을 상대로 유사 취지의 소송을 냈다.</p><p>1심과 2심은 원천징수 세액으로 법인세가 공제·충당된 점에서 정부가 법인세 1530억원, 서울시가 지방소득세 152억원 총 1682억원을 론스타 측에 돌려줘야 한다고 판단했다.</p><p>대법원은 배당금을 지급하면서 원천징수한 세금의 환급청구권은 론스타가 아닌 세금을 납부한 회사에게 있다고 보고 사건을 다시 심리해야 한다고 판단했다. </p><p>대법원은 "법인세 부과처분이 취소된 이상 원천징수세액 환급금을 법인세 기납부세액으로 공제·충당 처리한 효력이 소멸하게 됐다"며 "이에 따라 공제·충당 처리된 원천징수세액에 관한 환급청구권은 납부 명의자인 원천징수의무자들에게 속한다고 봐야 한다"고 판시했다. </p><p>대법원은 "법인세 부과처분은 원천징수 과정에서 기준이 되었던 중간 지주회사들을 납세의무자로 삼았던 것이 아니라 그 상위투자자인 원고들이 실질귀속자로서 납세의무자에 해당함을 전제로 한 것"이라며 "원천징수세액이 원천징수의무자들 명의로 납부된 이상 국세환급금에 대한 권리는 원천징수의무자들에게 있다고 보는 것이 타당하다"고 했다. </p><p>대법원은 "원천징수의무자들 명의로 납부된 세액이 원고들에 대한 법인세에 공제·충당된 적이 있다거나 법인세 부과처분이 취소되었다는 사정만으로 원고들이 원천징수세액 상당의 환급금 지급을 구할 수 있다고 단정하기 어렵다"고 했다.</p><p>◎공감언론 뉴시스 [emailprotected] 론스타 1600억원대 세금 반환소송…대법, 정부 승소 취지 파기환송(종합) :: 공감언론 뉴시스 ::	查看 1892	纽西斯通讯社	2025-04-25 19:56:24 2025-04-25 21:40:46	word

[emailprotected]</p></p>[서울=뉴시스]정금민 신재현 신유림 수습 기자 = 문재인 전 대통령은 25일 국회를 찾아 윤석열 정부의 지난 3년을 "대한민국 퇴행의 결정판이었다"며 작심 비판했다.</p><p>문 전 대통령은 이날 국회 도서관에서 열린 "4·27 판문점선언 7주년 기념식" 기념사에서 "마음 편할 날이 없었던 3년이었다. 나라가 국민을 걱정하는 게 아니라 국민이 나라를 걱정해야 하는 나날이었다"며 이같이 말했다.</p><p>문 전 대통령은 윤석열 정부 시기 고물가·고금리·고환율에 따른 경기 침체와 저성장 문제, 수출 성적 악화 등의 문제를 조목조목 지목했다. 그러면서 "이토록 경제가 어려운 데도 국가재정은 제 역할을 못했고 경제를 살리기 위한 재정의 적극적 역할을 회피했으며 2027년까지 60조원 이상의 추가 세수 감소가 전망되고 있다"고 했다.</p><p>문 전 대통령은 "윤석열 정부의 모든 분야에 걸친 총체적인 국정 파탄은 대통령 한 사람의 실패가 아니다. 집권 세력의 낡은 이념과 낡은 세계관, 낡은 안보관과 낡은 경제관이 총체적인 국정 실패를 초래했다"며 "방심하면 언제든 역사를 거스르는 퇴행적 시도가 일어날 수 있다"고 강조했다.</p><p>그는 또 "12.3 비상계엄은 대한민국 퇴행의 결정판이었다"며 "방심하면 언제든지 역사를 거스르는 퇴행적 시도가 일어날 수 있다는 것, 늘 "깨어 있는 시민"(깨시민)들의 조직된 힘이 있어야 역사의 반동을 막고 계속 전진할 수 있다는 사실을 국민들은 새삼 절감하게 됐다"고 말했다.</p><p>이어 오는 6월 3일 치러지는 대선과 관련해 "퇴행과 전진을 반복해 온 역사도 이제 종지부를 찍을 때가 됐다"며 "국민이 선택하게 될 새 정부가 국민과 함께 훼손된 대한민국의 국격을 회복하길 기대한다"고 했다.</p><p>대북정책을 두고는 "안에서 새는 바가지 밖에서도 새는 법이다. 남북 관계는 지난 3년간 회복이 어려울 정도로 망가졌고 한반도 평화를 향한 역대 정부의 노력과 성과는 송두리째 부정됐다"며 "군사적 충돌의 위험을 피하기 위해서는 9·19 군사합의를 복원하는 것이 출발점"이라고 말했다.</p><p>우원식 국회의장은 "지난 2018년 4월 27일 남북 정상은 손을 잡고 군사 분계선을 오가며 통일로 나아가자고 선언했다. 남북 관계가 9년여의 퇴행을 뒤로하고 본궤도로 돌아왔고 판문점은 평화체제 구축을 약속하는 무대로 전환됐다"며 "그러나 그로부터 7년 지금 우리는 최악으로 치달은 남북 관계의 위기와 우발적 군사충돌까지 걱정해야 하는 현실에 있다"고 밝혔다.</p><p>그는 "지난 12·3 계엄을 상기해보면 북한 위협을 명분으로 내세웠고 계엄을 정당화하기 위해 남북 충돌을 유도하려 한 정황까지 드러났다"며 "이제 민주주의를 회복하고 그 힘으로 평화의 수레바퀴를 다시 돌려야 한다. 대결을 넘어서고 신뢰를 쌓으며 평화의 지평을 확장했던 그 역사를 반드시 복구해야 한다"고 강조했다.</p><p>그러면서 "대화 없이는 위기를 관리할 수도 평화를 만들 수도 없다. 대화를 재개하고 걸음을 재촉하고 9.19 군사합의를 복원해서 우발적 군사 충돌 가능성을 봉쇄해야 한다"며 "국회도 평화와 공동 번영의 시대로 나아가기 위한 구체적인 실천 방법을 찾겠다"고 했다.</p><p>박찬대 더불어민주당 당 대표 직무대행 겸 원내대표는 "남북이 주도한 4.27 판문점 선언은 9.19 평양 공동선언과 군사 합의로 이어졌고 북미 정상회담의 문을 여는 출발점이 됐다"며 "그러나 안타깝게도 윤석열 정부는 그 시계를 거꾸로 돌렸다. 민주당은 평화의 정신을 계승해 다가올 대선에서 반드시 승리하겠다"고 했다.</p><p>이 자리에는 민주당 대선 경선 주자인 김경수·김동연 후보도 참석했다. </p><p>김경수 후보는 이날 기념식 후 기자들과 만나 검찰의 문 전 대통령에 대한 뇌물수수 혐의 기소에 대해 "검찰이 왜 수사 기능이 해체되어야 하는지를 분명히 각인시켜준 사건"이라며 "더이상 검찰에게 수사 기능을 맡길 하등의 이유가 없다. 수사검찰, 정치검찰은 다음 정권 교체 이후에 차기 민주 정부에서는 반드시 해체되어야 한다"고 했다.</p><p>전남 지역 일정을 소화 중인 이재명 후보는 페이스북 글을 통해 "한반도 평화를 위한 여정, 멈추지 않겠다"는 입장을 내놓았다. 이날 기념식에는 이 후보를 대신해 윤호중 경선 캠프 선대위원장이 참석했다.</p><p>이 후보는 "7년 전 남북 정상은 판문점에서 마주 앉았고 전쟁 없는 한반도와 공동 번영을 위한 역사적인 공동선언문을 채택했다. 그러나 지금, 적개심과 강경 일변도의 대북 정책으로 남과 북의 소통은 단절되고 신뢰가 훼손됐다"며 "남북이 다시 대화하고, 협력하며 신뢰를 쌓아야 한다"고 했다.</p><p>이어 "트럼프 행정부와 긴밀히 공조하고 주변국들과 협력하며 국익을 위한 실용외교를 펼쳐간다면 우리는 다시 기회를 잡을 수 있을 것"이라며 "한반도 평화는 군사적 긴장 완화를 넘어 남북 모두의 사회·경제적 비용의 절감과 동아시아 협력 및 공동 번영을 촉진할 것"이라고 했다.</p><p>◎공감언론 뉴시스 [emailprotected], [emailprotected], [emailprotected] 문재인 "尹정부 3년은 대한민국 퇴행 결정판…남북관계도 망가져"(종합) :: 공감언론 뉴시스 ::	查看 2891	纽西斯通讯社	2025-04-25 15:13:43 2025-04-25 21:40:46	word
